A MAN has appeared in the Mackay Magistrates Court charged with stalking after he allegedly posted naked photos of an ex-girlfriend on a Mackay social media page.

It is alleged a post appeared within a closed Facebook group that included multiple naked photos of a woman.

Currently there are more than 8900 members of this group which is specific to the Mackay area.

Following a complaint made to police, Mackay Criminal Investigation Branch detectives, on August 18 this year, charged a man with stalking.

Joshua Don Francis Wales, 24, had his second appearance in court yesterday before Magistrate Damien Dwyer.

The North Mackay man's first appearance was on September 2 where he was formally charged with unlawfully stalking a woman between August 15 and August 19 in Mackay.

Legal Aid Queensland duty solicitor Chelsea Cross said Wales was seeking an adjournment because he was still in the process of his legal aid application.

Mr Dwyer adjourned the matter until mid next month.

Under the Queensland Criminal Code Act 1899 unlawful stalking can involve an act that causes detriment, which includes "serious mental, psychological or emotional harm".

The maximum penalty for unlawful stalking is five years imprisonment.

Another offence under the Criminal Code is distributing prohibited visual recordings, which has a maximum penalty of two years jail.

Crime Prevention Unit Sergeant Nigel Dalton said this type of behaviour shouldn't happen.

"It's completely against what society would expect... it's not compassionate, it's not courteous," Sgt Dalton said. "We should deal with each other how we wish to be dealt with ourselves."
